Legal Requirements

As a business owner or food handler, you have a duty to comply with the provisions of Regulation (EC) 852/2004 of the European Parliament on the Hygiene of Foodstuffs, the Food Safety Act 1990, Food Hygiene (England) Regulations 2005.

By law, you also need HACCP training if you are responsible for developing or maintaining a FSMS (Food Safety Management System).

The Catering Industry Guide (which EHOs follow when interpreting legal requirements) states suitable food hygiene training courses for different job roles: 

  • Caterers preparing open high risk foods must have obtained a Foundation (Level 2) Food Hygiene Certificate (or an equivalent level of training) within three months of starting work. Prior to this, they need to be closely supervised. 
  • It is good practice for caterers who supervise others to also have an Intermediate (Level 3) Food Hygiene Certificate and/or an Advanced (Level 4) Food Hygiene Certificate.
